The Dutch Senate approved a bill on 29 September changing what tenants can bring before the Huurcommissie, the country’s rent tribunal. The government says the law will take effect on 1 January 2027. [1]
Under the changes, social-sector tenants will be able to challenge a rent increase specified in their tenancy agreement. The government says tenants in the middle-rent and liberalised sectors can already do this. Middle-rent tenants will also be able to challenge an annual increase if the Huurcommissie established, before the increase took effect, that their home had serious defects. That option currently applies only to social-sector tenants. [1]
Tenants will have to report defects to their landlord in writing before bringing a case about them to the Huurcommissie. [1]
The Huurcommissie’s procedure for complaints about landlords’ conduct will end. The government says tenants can take such complaints to a municipal reporting point, their housing association or the courts. [1]
