President Donald Trump has accused Texas Democrat Leticia Gutierrez of opposing tax breaks for tips, overtime and Social Security, but gave no evidence for the claim in his post. He predicted all three would be terminated if she and the Democrats came to power.
Trump made the claim in a 2 November Truth Social post endorsing Gutierrez’s Republican opponent, Alex Mealer, in Texas’s 9th congressional district. The post, recorded by the Trump’s Truth archive, appeared on the eve of the 3 November election. The archive shows Trump had made a nearly identical tax attack on Gutierrez the previous day, and used the same accusation against another Texas Democrat, Evan Hunt.
In a candidate questionnaire published by iVoterGuide, Gutierrez said the wealthiest individuals and large corporations could contribute more while taxes and costs were cut for working families and small businesses. She also said Social Security benefits should not be cut. Those answers do not address the three tax deductions individually: protecting benefit payments is not the same as exempting them from tax.
All 212 House Democrats voted against the broader 2025 law containing the deductions, which passed 218–214. That was a vote on the whole package, not on the tax breaks individually. In May 2025, the Senate passed a separate tips-deduction bill without objection, with support from Democratic senator Jacky Rosen and Republican Ted Cruz. Rosen had argued for passing the measure separately from a larger bill she said would cut Medicaid and food assistance.
Democratic representative Angie Craig also proposed ending income tax on Social Security benefits while extending Social Security payroll taxes to earnings above $250,000. In September 2025, fellow Democrat Emilia Sykes co-sponsored a proposal to expand eligibility for the overtime deduction. Those proposals do not establish Gutierrez’s position.
According to the Internal Revenue Service, the 2025 law allows eligible workers to deduct up to $25,000 in qualifying tips from taxable income. The overtime deduction covers only the extra pay above a worker’s regular rate – the extra half in time-and-a-half, for example – and is capped at $12,500 for an individual return or $25,000 for a joint return. Income and eligibility restrictions apply, and payroll taxes can still apply to tips.
Eligible taxpayers aged 65 or over can claim an additional deduction of up to $6,000 per person. It is not a blanket exemption for Social Security benefits, which can still be subject to income tax depending on the recipient’s circumstances.
The US Treasury said more than 7.5 million filers claimed the tips deduction and more than 29 million claimed the overtime deduction by the April 2026 filing deadline.

All three deductions are set to expire after the 2028 tax year unless extended, regardless of who wins the election. Trump did not say whether he meant an earlier repeal or a failure to extend them.
