A Benelux trademark decision backs FrieslandCampina’s claim to yellow on Chocomel packaging after a challenge to a Spanish rival’s application.

FrieslandCampina has secured exclusive Benelux trademark rights to the yellow used on Chocomel packaging, according to an ANP report on a recent decision by the Benelux Office for Intellectual Property. The ruling follows the dairy group’s challenge to a trademark application by Spanish rival Grupo Cacaolat. ANP did not give the date of the decision. [1]
Grupo Cacaolat applied in 2025 to register a Benelux trademark for its Chocolat brand using the same yellow, ANP reported. FrieslandCampina argued that the combination of logo, colour and brand name could confuse consumers and unfairly benefit from Chocomel’s reputation. Grupo Cacaolat disputed that argument, saying in part that chocolate-milk makers use yellow to indicate that their products are made with cocoa. [1]
Chocolat is sold in the Netherlands through several online shops specialising in Spanish products, according to ANP. The right described in its report concerns Chocomel packaging in the Benelux, not every use of yellow. [1]
