AI ANALYSIS & OPINION

The president’s law raised the exemption to $15 million per person rather than scrapping the levy. His Kansas message also links a nationwide biofuel income forecast to local farmers and promises a permanent change to E15 sales.

The US federal estate tax remains in force, contradicting Donald Trump’s claim that he ended it to protect family farms. His tax law increased the exemption rather than abolishing the levy on property passed on at death. [1] [2]
The claim appeared in a 19 October 2026 Truth Social post preserved by the Trump’s Truth archive. It combined the tax assertion with biofuel promises for Kansas farmers and a pledge to make year-round E15 sales permanent with Senator Roger Marshall in office. Trump campaigned for Marshall in Park City, Kansas, that evening. [1] [10]
The law approved on 4 July 2025 set the basic estate-and-gift-tax exemption at $15 million per person from 2026, with inflation adjustments thereafter. It also prevented the higher exemption introduced in 2017 from expiring at the end of 2025. That provides genuine tax relief compared with the lower threshold previously scheduled to return, but the tax remains, with a top rate of 40%. The exemption is not specific to farms. [2] [3]
Earlier Agriculture Department modelling illustrates the tax’s limited reach among farming households. Its Economic Research Service forecast that 141 of an estimated 41,104 estates arising from principal farm operators’ deaths in 2024 would owe estate tax—about 0.3%, with a combined liability of $1.1 billion. Those are estimates for 2024, not a measurement of the new law’s effects in 2026. [3]
There are real changes behind Trump’s biofuel message. On 27 March 2026, the Environmental Protection Agency announced final Renewable Fuel Standard obligations for 2026 and 2027, which it described as the highest in the programme’s history. [4]

Trump called these “production targets”. In practice, the programme sets obligations for renewable fuel in the national fuel supply: refiners can blend biofuels or buy tradable compliance credits. The totals are 26.81 billion ethanol-equivalent credits for 2026 and 27.02 billion for 2027, rather than direct targets for domestic production. The conventional biofuel level—important to corn ethanol producers—remains at 15 billion gallons in each year. [4] [5] [11]
The income figure comes from Agriculture Secretary Brooke Rollins. In the March announcement, she said the higher volumes were expected to increase US net farm income by $3 billion to $4 billion. Trump used the upper end of that national range and linked it to Kansas. [1] [5]
His rally speech was more explicit: he said the targets would create “$4 billion in new farm income for the farmers of a place called Kansas”, according to Roll Call’s Factbase transcript. Rollins’s national forecast does not establish that state-level gain. Her statement in the EPA announcement specifies neither a Kansas share nor the period over which the income increase is expected. [5] [10]
The policy has agricultural supporters as well as industry opponents. Reuters reported that the National Corn Growers Association welcomed the decision, while the refining trade body American Fuel & Petrochemical Manufacturers opposed it. [11]
Kansas did benefit from temporary fuel waivers. E15 is petrol containing 15% ethanol, and EPA’s nationwide measures relaxed seasonal fuel standards. The relevant provision of the waiver announced on 25 March initially covered 1–20 May 2026, followed by renewals during the summer. Similar nationwide E15 summer waivers were used in 2022, 2023 and 2024. This was temporary national relief that included Kansas, rather than a permanent permission granted specifically to the state. [7]
Trump’s post correctly presents permanent year-round sales as a future promise. Marshall also has a documented record of supporting reform: he was among the original co-sponsors of Senator Deb Fischer’s S. 593, introduced on 13 February 2025 to change the relevant Clean Air Act requirements. [1] [9]
A separate bill, H.R. 1346, passed the House by 218 votes to 203 on 13 May 2026 and was referred the following day to the Senate’s Environment and Public Works Committee. As recorded in the congressional calendar for 19 October, it still awaited further Senate action. [8]
At the Park City rally, Trump made his willingness to pursue permanent E15 sales explicitly dependent on the election result. Referring to Marshall’s opponent, Adam Hamilton, he said: “But if Adam Hamilton is in, I'm not doing it. That's it. I'm only doing it for him.” That explicit refusal if Hamilton wins was in the speech, not the Truth Social post: a condition attached to future action, not a permanent policy gain already secured.
